Waltons Back to School Model Search 2024 - Terms & Conditions

1. Eligibility

1.1 The Waltons Back to School Model Search 2024 ("Competition") is open to natural persons who are legal residents of the Republic of South Africa, aged between 5 (Grade 0) and 18 (Matric) as of the date of entry.

1.2 Participants must obtain written consent from a parent or legal guardian to enter the Competition. By submitting an entry, the parent or legal guardian ("the Consenting Party") confirms that they have read and fully agree to these Terms and Conditions on behalf of the minor entrant ("the Participant").

1.3 Employees of Waltons, Bidvest Group, it's subsidiaries, affiliates, advertising agencies, and their immediate families are eligible to participate. However, all entries will be evaluated based on identical criteria to ensure fairness and inclusivity.

1.4 Diversity and Inclusion: Waltons is committed to principles of diversity and inclusion. The Competition is open to all eligible Participants, regardless of race, gender, ethnicity, religion, or socio-economic status. The selection process will reflect these values to prevent discrimination.

2. Entry Requirements

2.1 To enter the Competition, the Participant or Consenting Party must make a purchase of R250 or more at any Waltons store or through the official Waltons online store between 1 September 2024 and 15 October 2024 ("the Qualifying Purchase Period"). Only purchases made within this period are considered valid for entry.

2.2 Participants must submit their entries either online or in-store using the provided QR codes. Both entry methods are valid, and no preference will be given to the method used.

2.3 Each entry must include:

   2.3.1 A clear, current photo of the Participant (file size not exceeding 2MB),

   2.3.2 A scanned or photographed copy of the purchase receipt, and

   2.3.3 A completed entry form containing accurate and complete information.

2.4 All entries must be received by 23:59 SAST on 15 October 2024. Late, incomplete, or invalid entries will not be considered, and no responsibility will be accepted for lost, delayed, or misdirected entries.

3. Selection Process

3.1 All valid entries will be reviewed by an independent panel of judges appointed by Waltons. The judging will be based on predefined criteria, including creativity, enthusiasm, school spirit, and alignment with the Waltons brand. The scoring rubric used for judging will be standardized and uniformly applied to all entries.

3.2 To avoid any appearance of bias or unfairness, the panel of judges will operate independently, and their decisions are final and binding on all Participants. No correspondence or discussion will be entered into regarding the judges' decisions, and Participants and Consenting Parties agree to accept the outcome without dispute.

3.3 Waltons reserves the right to disqualify any Participant or revoke any prize in the event that any fraud, misrepresentation, or misconduct is discovered during or after the Competition. The decision to disqualify and/or revoke is within the sole discretion of Waltons, and no compensation will be given in such circumstances.

4. Prizes

4.1 The winners will be featured in Waltons' Back to School 2024 TV and radio advertisements ("the Advertisements"). Additional prizes may include school supplies and discount vouchers, which will be determined and distributed at the sole discretion of Waltons.

4.2 All prizes are awarded "as is" and are non-transferable, non-exchangeable, and cannot be redeemed for cash or any other form of compensation.

4.3 Waltons reserves the right to substitute any advertised prize with a prize of equal or greater value if the original prize is unavailable for any reason beyond Waltons' control.

5. Use of Personal Information

5.1 By entering the Competition, the Consenting Party agrees on behalf of the Participant to the collection, processing, and use of personal information as required for the administration of the Competition, in accordance with the Protection of Personal Information Act, No. 4 of 2013 (POPIA).

5.2 Personal information will be used solely for the purposes of this Competition and related marketing activities by Waltons. Such information will be securely stored and will not be shared with third parties without the explicit consent of the Consenting Party, except where required by law.

5.3 All personal information will be retained only for as long as necessary to fulfill the purposes for which it was collected, after which it will be securely destroyed. The Consenting Party has the right to request access to, correction of, or deletion of the Participant's personal data at any time, subject to applicable laws.

6. Liability and Indemnity

6.1 To the fullest extent permitted by law, Waltons, Bidvest Group, their affiliates, and subsidiaries, and their respective directors, officers, employees, agents, and contractors (collectively, "Indemnified Parties") disclaim all liability for any loss, injury, damage, or harm (whether direct, indirect, incidental, or consequential) arising from or in connection with the Competition, participation in the Competition, the awarding or use of any prize, or any breach of these Terms and Conditions by a Participant or Consenting Party.

6.2 The Consenting Party, on behalf of the Participant, agrees to indemnify, defend, and hold harmless the Indemnified Parties from and against any and all claims, liabilities, damages, losses, and expenses (including legal fees) arising from or in connection with any act or omission by the Participant or Consenting Party in relation to the Competition.

7. General

7.1 Waltons reserves the right, in its sole discretion, to amend, modify, or terminate the Competition at any time and for any reason, without prior notice or liability. In the event of any such changes, Waltons will take reasonable steps to communicate the changes to Participants.

7.2 These Terms and Conditions constitute the entire agreement between Waltons and the Consenting Party/Participant concerning the Competition. Any failure by Waltons to enforce any of its rights or provisions under these Terms and Conditions shall not be construed as a waiver of such rights or provisions.

7.3 These Terms and Conditions are governed by and shall be construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of South Africa.

7.4 In the event of a dispute regarding the interpretation of these Terms and Conditions, Waltons’ decision shall be final and binding, and no further correspondence will be entered into.

8. Model Release

8.1 By entering the Competition, the Consenting Party grants Waltons, on behalf of the Participant, an irrevocable, perpetual, royalty-free license to use, reproduce, publish, and distribute the Participant's image, voice, and likeness in any media format (including digital, print, and broadcast) for any lawful purpose related to Waltons' marketing, advertising, or promotional activities, without any further consent, notice, or compensation.

8.2 The Consenting Party agrees, on behalf of the Participant, to waive any rights, including moral rights, in relation to the use of the Participant's image, voice, and likeness, and agrees not to institute any claims against Waltons in this regard.
